Notice is hereby given that the Pokegama Township Board of Supervisors approved a Point-of-Sale requirement amendment to the Sewer Use Ordinance at its December 11, 2025, regular meeting. The Point-of-sale requirement will take effect on July 1, 2026.
Sec. 13 Point of Sale requirements for Private Building Drains for Inflow/Infiltration Reduction
No person shall sell, advertise for sale, give or transfer a change in title or ownership of real property with one or more buildings connected to the wastewater collection system without first obtaining a “Certificate of Sump Pump” or a Certificate of Compliance” from the Township. A certificate of compliance will be issued upon successful completion of the inspection. A certificate of compliance shall be valid until the property is again offered for sale, gifted or transferred, and before an owner/representative enters into any contract for deed or other transactions changing party responsible for the property. If the property owner already has a certificate of compliance filed at the Township that is more than one (1) year old, a sump pump inspection is still required for all properties containing sump pumps.
The requirement to inspect applies to all properties connected to the Township sewer collection system and includes all private laterals on the parcel. The inspection of the building drain lateral may be conducted under the direction of the property owner (seller), the purchaser (buyer), or their authorized agents.
The inspection should be conducted by a Minnesota Certified licensed contractor. An inspection shall be completed utilizing television video inspection equipment and, in a manner, that ensures the inspection report requirements can be accurately provided. The inspector must complete a Point-of-Sale private building/lateral inspection form. The inspection report must be provided to the buyer, seller and the Township at least 15 days prior to the closing or to the establishment of an escrow account.
For properties that pass inspection, the Township issues a Certificate of Compliance to the property owner which will be valid up to any additional transfer of property. For properties that fail the inspection, the Township will issue a correction notice delineating the problems and correction time frame requirements. For private laterals that fail the compliance inspection, the property owner has 90 days from the date of notice to correct the issues making the building drain non-compliant.
If an inspection discloses that a use of property is not in accordance with the Township Sewer Use Ordinance, a correction notice may be issued permitting the transfer of the property providing:
An agreement by the owner or owner’s representative agrees to complete corrections to the property necessary to bring it within compliance within 90 days or directed by the Town Board on a case-by-case basis.
